ELUNA — TERMS OF SALE

1. Overview
These Terms of Sale ("Terms") govern the purchase of products from Eluna ("we", "us", "our") through our website elunasleep.com and related sales channels (the "Store"). By placing an order, you agree to these Terms together with our Terms of Service, Privacy Policy and Refund Policy, which are incorporated by reference. Please read them carefully before ordering.

2. Eligibility
By placing an order you confirm that you are at least the age of majority in your country of residence and that you are purchasing for your own personal or household use, not for commercial resale or export.

3. Products
We take care to describe and display our products accurately. However, colours and appearance may vary depending on your device and screen. Product descriptions, specifications and availability may change at any time without notice. We may limit quantities or discontinue any product at our discretion.

4. Orders and Acceptance
When you place an order you make an offer to purchase the selected products at the stated price. Your order is only accepted once we send you a confirmation email and payment has been successfully processed. We reserve the right to accept or decline any order at our discretion, including where we suspect an error in pricing, a limitation on quantity, or a payment or fraud issue. If we cannot accept or must cancel your order, we will notify you using the contact details you provided and refund any amount already charged.

5. Prices and Payment
All prices are shown in the currency displayed at checkout and are subject to change without notice. The price applied is the one in effect when your order is placed, as set out in your order confirmation. Unless stated otherwise, prices do not include taxes, shipping, or any customs or import charges, which may apply depending on your delivery destination and are your responsibility. Payment is taken at the time of order through our approved payment providers. You confirm that the payment details you provide are accurate and that you are authorised to use the chosen payment method.

6. Shipping and Delivery
Estimated delivery time is 6 to 9 working days from dispatch, depending on your location. All delivery times are estimates and are not guaranteed. We are not liable for delays caused by carriers, customs processing, incorrect delivery information, or events outside our control. Risk of loss passes to you once the products are handed to the carrier. If a package is confirmed lost in transit, contact us and we will work to resolve it, including arranging a replacement where appropriate.

7. Cancellations, Returns and Refunds
Your order is covered by our Refund Policy, including our 30-night satisfaction guarantee. If you are not satisfied, contact us at hello@elunasleep.com within the guarantee period and we will guide you through the return or refund process. Consumers in the UK and EU also benefit from statutory cancellation and return rights, which are not affected by these Terms. For hygiene reasons, certain items may be excluded from return once opened or used, except where they are faulty or you are exercising a statutory right.

8. Product Use and Safety
Eluna products are designed to support healthy sleep posture and are not medical devices. They are not intended to diagnose, treat, cure or prevent any medical condition. Any wellbeing or developmental information provided is for general information only and does not replace professional medical advice. Always follow the age guidance and care instructions supplied with the product, and consult a qualified healthcare professional if your child has a specific medical concern.

9. Warranties and Consumer Rights
Our products are sold with the guarantees required by applicable consumer law, including that they correspond to their description and are of satisfactory quality. Nothing in these Terms excludes or limits your statutory rights as a consumer. Except for those non-excludable rights, products are otherwise provided without additional warranties beyond those expressly stated by us.

10. Limitation of Liability
To the fullest extent permitted by law, Eluna will not be liable for any indirect, incidental, special or consequential loss arising from your purchase or use of our products. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be excluded under applicable law. Where our liability cannot be excluded but can be limited, it is limited to the amount you paid for the relevant product.

11. Errors
Occasionally information in the Store may contain typographical errors or inaccuracies relating to descriptions, pricing, promotions, shipping charges or availability. We reserve the right to correct any errors and to change or update information or cancel orders where information was inaccurate, including after an order has been submitted.

12. Governing Law
These Terms are governed by the laws of France, without regard to conflict of law rules. The competent courts of Paris, France shall have jurisdiction, except where mandatory consumer protection law grants you the right to bring proceedings in the courts of your country of residence.
